Tracy Tirey
Attorney at Law
Tracy has practiced law for over 24 years. She is an experienced litigator, investigator, negotiator and planning attorney. She acquired these skills in a long career that includes almost 12 years as an Assistant District Attorney in the Harris County District Attorney’s Office in Houston, Texas, where she handled large misdemeanor and felony court dockets and was the lead prosecutor in over 100 jury trials involving a wide range of offenses, including drugs, fraud, DUI, theft, assault, sexual assault, burglary, aggravated robbery and murder; and another 10 years investigating and aiding in the litigation of securities violations with the Enforcement Division of the United States Securities and Exchange Commission (SEC) in Denver, Colorado. She earned her bachelor’s in business administration, with a concentration in International Business, from the University of Texas at Austin and worked with an international tile manufacturer and importer before entering law school and earning her juris doctor from the University of Houston. As a lifelong learner, Tracy is constantly seeking new experiences and new information. She regularly attends legal and financial seminars, workshops, and conferences in order to provide her clients with cutting edge legal and planning strategies.

Tracy dreamed of opening her own law practice near her home in Westminster, Colorado as a way of combining her understanding of business, criminal and securities laws, her desire to protect families and individuals, especially elders, from exploitation and injustice, and her interest in developing relationships within her local community. In 2011, when her daughter reached school age, she made that dream a reality and opened the Tirey Law Firm, LLC. In 2013, she combined her practice with family lawyer Dawn M. O’Neil and formed Tirey O’Neil, LLC. Together Tracy and Dawn seek to guide families through life’s trials and transitions. Tracy has handled criminal cases involving minors and incompetent seniors, DUIs, felonies and misdemeanors; family law matters involving divorce, divorce mediation, and child custody; but the bulk of her practice these days involves estate planning and elder law issues: Will and Trust based estate plans; Medicaid planning; guardianship and conservatorship matters and probate and trust administration.

Personal background: Tracy comes from a large military family. So, she got used to moving to new places and meeting new people at an early age. By the time she was 12, Tracy and her family had lived in three countries and five states (and one state on three separate occasions) and Tracy had attended 6 different elementary schools. These early experiences instilled a love of travel, languages, and foreign cultures in Tracy and her three siblings. After her father retired from the Air Force, her family settled in Tyler, Texas, where Tracy graduated High School. During College, at the University of Texas, Tracy spent a year abroad as an exchange student in Frankfurt and Berlin, Germany. After College, Tracy began coming to Colorado every year to ski and true to the adage “they come for the winters, but stay for the summers,” after her first summer visit here, Tracy was determined to stay. She moved to Colorado in 2001, met and married her husband and started a family here. She and her family have made their home in Westminster, Colorado where they participate in many community and outdoor activities in Westminster and Broomfield.

Memberships and Associations: 1989 licensed to practice law in Texas (currently inactive); 2009 licensed to practice law in Colorado; Colorado Bar Association (CBA) — Elder law, Trusts and Estates, and Business law sections; the Adams/Broomfield County Bar Association; The National Academy of Elder Law Attorneys, Inc. (NAELA); and national estate planning and elder care organizations- WealthCounsel, Inc., and ElderCareMatters.

Training and Continuing Legal Education: National Institute of Trial Advocacy (NITA) Trial Skills and Deposition courses, the Colorado Bar Association (CBA) 40 hour mediation course, the Colorado Collaborative Divorce Professionals (CCDP) Level One collaborative law training, Northwestern University’s Securities Law Training Course (2005). Tracy has also completed hundreds of hours of continuing legal education, through national and local courses, seminars, symposiums, updates and self study in the areas of estate planning and elder law, including courses related to: Wills, Trusts, Medicaid and VA benefit planning, disability planning, tax planning, probate and trust administration, and competency issues in civil and criminal law involving seniors and disabled individuals.

Other interests and activities: Tracy fills any free time she can find with family activities. She and her family are all avid skiers, hikers and outdoor enthusiasts. Her volunteer experience includes mentoring youth in the Denver metro area through Friends for Youth; coaching high school students for Mountain Range High School’s Mock Trial Team. When time permits, Tracy still enjoys travel, languages (conversational Spanish and German and Italian), book club, and spending time with a wonderfully diverse international group of friends.
